Rural Terrain, Elevated Structures, Weather Conditions, and Property Access

By making a reservation, accessing the property, or staying at STELLARA, guests acknowledge and agree to the following:

Assumption of Risk

STELLARA is located in a natural, mountainous environment with uneven terrain, elevated structures, outdoor pathways, and variable weather conditions.

Guests understand that the property includes, but is not limited to:

  • Elevated treehouses and structures
  • Exterior staircases and elevated decks
  • Gravel, dirt, and uneven walking surfaces
  • Hiking paths and natural terrain
  • Wildlife and insects
  • Limited lighting in outdoor areas
  • Weather conditions including rain, ice, snow, fog, and wind
  • Slippery surfaces due to moisture or natural elements

Guests voluntarily assume all risks associated with navigating and staying on the property.

Use of Stairs, Decks, and Elevated Areas

Many accommodations at STELLARA require the use of stairs and elevated walkways.

Guests acknowledge:

  • Some staircases are steep and outdoors
  • Surfaces may become slippery due to weather
  • Elevated decks and railings require caution
  • Proper footwear is strongly recommended

Guests accept full responsibility for their safety while using these features.

Weather Conditions

The Smoky Mountains region is subject to sudden and changing weather conditions.

Guests understand that:

  • Rain, ice, snow, or fog may impact visibility and footing
  • Outdoor areas may become hazardous
  • Power or utility interruptions may occur

Guests assume all risks related to weather conditions during their stay.

Wildlife and Natural Environment

STELLARA is located in a natural setting where wildlife may be present.

Guests acknowledge potential encounters with:

  • Insects
  • Reptiles
  • Birds
  • Mammals

Guests agree to exercise caution and not approach wildlife.

Limitation of Liability

To the fullest extent permitted by law, STELLARA, its owners, employees, affiliates, and agents shall not be liable for:

  • Personal injury
  • Accidents or falls
  • Illness
  • Loss or damage to personal property
  • Injuries resulting from weather conditions
  • Injuries related to terrain, stairs, decks, or natural features

except in cases of gross negligence or willful misconduct.

Guest Responsibility

Guests agree to:

  • Exercise caution while on the property
  • Follow all posted safety instructions
  • Supervise themselves and any visitors
  • Use amenities responsibly

Guests are responsible for any damage caused by themselves or their party.

Acknowledgment and Acceptance

By completing a reservation, entering the property, or staying at STELLARA, guests acknowledge that they have read, understood, and voluntarily agreed to this Liability Waiver and Assumption of Risk.
